Representatives Gary Click and Nick Santucci have reintroduced the 'America First Act' aimed at combating unlawful immigration in the state of Ohio. The proposed legislation, according to its sponsors, aligns with existing federal immigration policies by addressing only those immigrants identified as unlawful at the federal level.
The Act stipulates a penalty for unauthorized immigrants in Ohio, which includes a $500 fine and a year in jail. Repeat offenders face elevated penalties, and individuals found in violation are required to exit the state within 72 hours following their release.
"The America First Act sends the message that we welcome lawful immigrants, and we value those who value America enough to knock and come through the front door," stated Representative Click. He mentioned that legal immigrants have expressed gratitude for the United States and are offended by those who bypass legal entry channels.
The legislation mandates that law enforcement agencies report detainees, identified as unlawful immigrants, to the Immigration and Customs Enforcement (ICE) and allows for their transfer to ICE for deportation at any point during their sentence. Additionally, local law enforcement and detention facilities are required to honor lawful detainer requests from ICE, with subdivisions failing to comply facing a $500 deduction from local government funds.
Ohio law enforcement is authorized by this bill to work alongside federal authorities to maintain an orderly and lawful immigration framework. Representative Santucci emphasized Ohio's role, stating, "The ability for migrants to easily bypass our laws undermines the value of citizenship and weakens the integrity of the immigration process."
The proposed legislation, known as HB 200, is pending a committee assignment and awaits its first hearing.
